(hereinafter referred to as the &#8220;platform&#8221;, &#8220;ORNELLA DESIGN&#8221;, the &#8220;Company&#8221; or &#8220;we&#8221;) is a company that offers advertising and promotion services (through internal capabilities or subcontracting), including consulting, creative services, production of advertising materials, and their purchase.<\/p>\n<p>This <i>Personal Data Processing Agreement (<\/i>the &#8220;Agreement&#8221;) accompanies all relationships established between ORNELLA DESIGN and its users, namely the service beneficiaries, and informs about how the personal data provided by you is processed, in accordance with the current legislation in the field.<\/p>\n<p>For the fulfillment of its purposes, ORNELLA DESIGN is a personal data operator. This Agreement contains important information and must be read in its entirety to fully understand and knowingly accept its provisions. <\/p>\n<p>We encourage you to contact us regarding any misunderstandings, suggestions, or recommendations related to this Agreement and\/or its clauses.<\/p>\n<h4><i>II. PERSONAL DATA PROCESSED: <\/i><\/h4>\n<p>To provide the offered services, we need to process the data you provide, including your <i>personal and contact data<\/i> (name, surname, personal identification number, gender, date of birth, phone number, email address, home address), <i>payment-related data<\/i> (account holder&#8217;s identification data, IBAN number, card number, card expiration date, as well as any other data necessary for payment).<\/p>\n<h4><i>V. PURPOSES OF PROCESSING:<\/i><\/h4>\n<p>We process the data you provide only for the purposes intended by the specific nature of the information. Thus: <\/p>\n<ul>\n<li>For the purpose of providing services, we will use your data to facilitate the provision of digital art sales services.<\/li>\n<li>For the purpose of fulfilling legal obligations, we will use the data in accordance with the provisions imposed by current legislation.<\/li>\n<li>For financial purposes, the provided data will be used for issuing invoices to you, receiving\/collecting payments, sending notifications, and other similar purposes related to your tax obligations.<\/li>\n<li>For the purpose of resolving disputes between parties, whenever necessary, before public authorities and competent bodies.<\/li>\n<\/ul>\n<h4><i>VI. LEGAL GROUNDS FOR DATA PROCESSING: <\/i><\/h4>\n<p>In principle, depending on how contractual relationships are established, we process your personal data, and driven by the specific nature of ORNELLA DESIGN (an online platform for selling digital art), it is necessary and evident that we also process your personal data, hereinafter referred to as <i>sensitive personal data.<\/i><\/p>\n<p>You must understand that the eventual lack of your express consent for the processing of personal data prevents the proper provision of services offered by ORNELLA DESIGN.<\/p>\n<p>In necessary cases, when disputes exist between parties, we process your data for the establishment, exercise, or defense of a right in court.<\/p>\n<h4><i>VII. RECIPIENTS OF THE PROVIDED DATA: <\/i><\/h4>\n<p>Due to the specific nature of the data you provide, our company does not disclose personal data to other companies or individuals, whether natural or legal persons.<\/p>\n<p>However, due to the specific nature of the services offered and the activity performed, there are situations where we may need to disclose this data to other persons\/entities, in order to fully meet your requirements or for mandatory purposes provided by law.<\/p>\n<p>Nevertheless, we assure you of our utmost diligence and proportionality regarding any disclosure of personal data to other persons, ensuring that this is done adequately, relevantly, and limited to what is necessary for the purposes for which they are processed.<\/p>\n<p>At the same time, we ensure that any person who comes into contact with your personal data in the manners described above will fully comply with confidentiality obligations regarding the provided data, as well as those to use the respective data in accordance with the instructions received.<\/p>\n<p>In principle, but not limited to these, we identify the following potential external recipients:<\/p>\n<ul>\n<li>Public authorities or competent institutions in Romania or another state \u2013 at their request or at our initiative, in compliance with applicable law;<\/li>\n<li>Lawyers or other professional consultants \u2013 these being obliged to maintain the confidentiality of your data, according to law or confidentiality clauses concluded with ORNELLA DESIGN;<\/li>\n<li>Natural\/legal persons authorized by ORNELLA DESIGN, who, based on the legal service provision relationship with the company, may come into contact with your personal data; \u2013 they will be obliged to maintain the confidentiality of the data known through this means;<\/li>\n<li>Acquirers or relevant potential acquirers \u2013 in the event of business transfer to external contractors, they will be bound by confidentiality;<\/li>\n<\/ul>\n<h4><i>VIII. TRANSFER OF DATA TO OTHER THIRD COUNTRIES: <\/i><\/h4>\n<p>ORNELLA DESIGN does not currently transfer your personal data to third countries or international organizations. In the event that it becomes necessary to send your data as mentioned above, you will be informed in advance. <\/p>\n<h4><i>IX. DATA RETENTION PERIOD: <\/i><\/h4>\n<p>Your personal data, according to their specific nature, will be stored for different periods of time.<\/p>\n<p>Thus:<\/p>\n<ul>\n<li>Payment\/billing data will be stored for a maximum period of 10 years, according to law;<\/li>\n<li>For other provided data, they will be stored only as long as necessary for processing for the purposes for which they were collected.<\/li>\n<\/ul>\n<p>We specify that, due to the specific nature of our platform and the services provided, ORNELLA DESIGN will archive your data when you leave the system. This data will not be used by ORNELLA DESIGN personnel in their work environment, except in situations required by law. In this manner, if the beneficiary requests, by following the steps defined within the platform, the reactivation of the account, their previously archived data will be imported, and their account will become active.  <\/p>\n<h4><i>X. YOUR RIGHTS regarding processed personal data:<\/i><\/h4>\n<ul>\n<li><i>Right to information \u2013 <\/i>you have the right to be informed about the processed data, the purpose for which they are processed, their recipients, as well as any other relevant information related to them, exactly as presented in this information notice;<\/li>\n<li><i>Right of access \u2013 <\/i>you have the right to obtain access to the processed data, as well as to all collateral information related to them, exactly as provided in Article 15 para. 1) of Regulation 679\/2016; <\/li>\n<li><i>Right to rectification of data \u2013 <\/i>you have the right to obtain the rectification of incomplete and inaccurate information concerning you;<\/li>\n<li><i>Right to erasure \u2013 <\/i>you have the right to have your data erased, in situations where Article 17 of Regulation 679\/2016 is applicable;<\/li>\n<li><i>Right to restriction of processing \u2013 <\/i>you have the right to request the restriction of processing of your data, when there is a basis for this;<\/li>\n<li><i>Right to data portability \u2013 <\/i>you have the right to request portability to another data operator, when this is necessary and feasible;<\/li>\n<li><i>Right to object \u2013 <\/i>you have the right to object to the processing of your data, when there is a basis for this;<\/li>\n<li><i>Right not to be subject to an automated decision-making process, withdraw consent \u2013 <\/i>we assure you that your data will not be subject to an automated decision-making process, based exclusively on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you;<\/li>\n<li><i>Right to withdraw consent \u2013 <\/i>according to applicable regulations, in cases where the processing of your data is based on your explicit consent, you have the right to withdraw this consent, without affecting the legality of data processing prior to withdrawal.<\/li>\n<\/ul>\n<h4><i>XI. DATA SECURITY: <\/i><\/h4>\n<p>Given the specific nature of the activity performed and the sensitivity of the personal data provided, the security and safety of your data are a priority for us. This is also why, to ensure a high level of data security, we have implemented a whole series of appropriate technical and organizational measures to ensure a level of security proportional to the risk to which this data is exposed. <\/p>\n<p>The adopted security measures fully comply with legal norms in the field and allow data processing under optimal conditions of confidentiality and security. However, we cannot guarantee the absolute impossibility of security system breaches that ORNELLA DESIGN could accidentally lead to the destruction, loss, alteration, or unauthorized disclosure of personal data transmitted, stored, or processed. <\/p>\n<p><b>In the unlikely event that this occurs, we assure you of our full diligence and promptness in reporting and resolving any security breaches that arise, as well as in limiting their effects.<\/b><\/p>\n<p>As such, in cases where a possible data security breach is reported, we will inform both our data operator and the competent persons to resolve this issue (e.g., IT department), while also evaluating the risks to the data subjects, and if measures are required to prevent further data loss, these measures will be taken.<\/p>\n<p>If the identified security breach is likely to pose a high risk to the rights of the data subjects, the competent authorities and the data subjects will be notified without undue delay, in order to enable them to exercise their rights, as well as to indicate the steps to be taken to ensure the protection of personal data.<\/p>\n<p>In all cases, we assure you of our full diligence and promptness in informing you about potential security breaches, as well as in minimizing or mitigating their effects on your rights.<\/p>\n<h4><i>XII. COMPLAINTS\/REQUESTS REGARDING PERSONAL DATA PROCESSING: <\/i><\/h4>\n<p>To exercise the aforementioned rights, the data subject may submit a written, dated, and signed request, using any of the contact methods provided in this GDPR notice. We will respond to these requests without undue delay and, in any case, within one month of receiving the request. Your request will be formulated and sent in accordance with legal provisions. <\/p>\n<p>In the case of complex or very numerous requests, this period may be extended by two months. In this case, we will inform the data subject about such an extension within one month of receiving the request, also stating the reasons for the delay.
